Regular Town Board Meeting-Monday, August 10, 2009-7:00 PM – Linn Town Hall

Supervisor Weiss called the meeting to order at 7:00 pm. Present at roll call were Supervisors Weiss, Palmer, Allis, Holden, Clerk Polyock, Atty. Schiltz. Chairman Bollweg was absent. There were twelve (12) people in attendance.

Holden/Palmer motion to approve the minutes as distributed. Carried without negative vote.

Holden/Palmer motion to approve the payment of bills including those submitted tonight totaling $159,273.53. Carried without negative vote.

Comments from the public: Allan Polyock commented on fire protection with Town of Geneva. It will cost a lot of money if the Town goes with Town of Geneva. The Town should look at contracting with Lake Geneva and Williams Bay.

Frank Heindl commented about repealing Section 12-4B. It is getting out of line when the inspector is to come into the house to tell you what to do. To replace shingles is a maintenance issue. It seems that every time someone has a complaint, you are making an ordinance.

Plan Commission: Supervisor Weiss reported the Matson Family Trust had appeared before the Plan Commission. Mr. Matson did not build the house. Weiss/Allis motion to approve the 13.5 foot setback for the Matson Family Trust existing house as recommended by the Plan Commission.Carried without negative vote.

Weiss reported a Special Plan Commission meeting was held prior to the Town Board tonight for a request by Steve Snudden to amend his existing conditional use permit to animal units (the current way of counting) vs. cows. Weiss/Holden motion to approve the amendment to Snudden Farms Conditional Use permit to allow for 938 animal units. Carried, Michael Palmer abstained.

Protective Services: Holden/Allis motion to table disposing of trucks #3360 & #3361. Carried without negative vote. A minimum bid will be established next month.

Highway Committee: Supervisor Holden stated two (2) bids were received for the pick-up, but one of them did not meet the specs. Holden/Palmer motion to accept the bid submitted by Lake Geneva Chevrolet for $34,096.00. Carried without negative vote.

Holden/Palmer motion to accept the bid of BR Amon for road work was withdrawn.

Holden/Allis motion to accept the bid from B.R. Amon to do all of Academy Road from S. Lakeshore Drive to County B and to table the action on Willow Road. Carried without negative vote.

Harbor Commission: Supervisor Allis reported we are 19% ahead of budget with boat launch receipts. The re-design of the traffic flow and wider ramp has helped this year.

Buildings & Grounds: Supervisor Holden reported the sidewalk needed to be upgraded for ADA requirement for voting. To replace the entire sidewalk, engineering fees alone are $5,000 to $6,000. The Fixer Guys will replace 4 sections of the sidewalk. Holden/Palmer motion to hire The Fixer Guys to make the Hall sidewalk ADA compliant with a bid of $1651.00 subject to proof of insurance. Carried without negative vote.

Public Parks: Will meet tomorrow night at the park.

LG Environmental Agency – Supervisor Palme stated they discussed the flooding at Robinson Hillside subdivision.

Atty. Schiltz gave some background stating that the State mandated that there are not to be more than 2 layers of shingles on a residential home enacted by the Department of Commerce. By requiring a building permit, the building inspector will go out to make sure residents are complying with this mandate. Holden/Allis motion to deny the repeal of Section 12-4B relating to building permits. Carried without negative vote. Schiltz then stated the Board will need to rescind the prior approval of the fee schedule that added $40 for a re-roof. Palmer/Allis motion to rescind the requirement for a $40 permit fee for re-roofing. Carried without negative vote. Palmer/Allis motion to refund the fees collected thus far for roofing permits. Carried without negative vote.

Atty. Schiltz explained that the Ordinance would be amended to allow no parking from Wildwood Drive south to S.Lakeshore Drive. Allis/Holden motion to waive the first reading and adopt the Ordinance to amend Section 9-5A relating to parking regulations. Carried without negative vote.

Atty. Schiltz explained this would add a 45 mph speed limit from Linton Road to S. Lakeshore Drive on Maple Ridge Road. Palmer/Holden motion to approve the first reading of the Ordinance to repeal and recreate Section 9-7 relating to speed limits. Carried without negative vote.

Atty. Schiltz explained an outside Atty. would be needed for the Police Committee as Schiltz has been asked to testify. Palmer/Holden motion to appoint Attorney Rasmussen to be the attorney for the Police Committee. Carried without negative vote.

Weiss/Allis motion to appoint Officer Dan Gerlitz to full-time status in the police department. Carried without negative vote.

Weiss/Allis motion to adjourn. Meeting adjourned at 7:40 pm.
