Regular Town Board Meeting – Monday, May 11, 2009 – 7:00 pm – Linn Town Hall

Chairman Bollweg called the meeting to order at 7:00 pm. Present at roll call were Chairman Bollweg, Supervisors Weiss, Palmer, Allis, Holden, Clerk Polyock, Atty. Schiltz. There were eleven (11) people in attendance.

Holden/Allis motion to approve the minutes as distributed. Carried without negative vote.

Weiss/Palmer motion to approve the payment of bills presented. Carried without negative vote.

Comments from the public: These pertained to the Lake Geneva Club pier and Chairman Bollweg limited the time to two (2) minutes. Atty. David Williams, representing Chicago Club, said the Town did not get notice that the meeting was held. The only explanation would be to appeal the decision and ask why Town was not notified. All notices went to Fontana. No one spoke in favor of the pier at the hearing.

Larry Youp, Chicago Club, stated at the hearing everyone in the room was against. The information on the application was to reduce, but the number they started with was too high and not accurate. Please appeal.

Wayne Huerth, Lake Geneva Club, states the appeal is a business decision. It makes sense to fight because the Town is enforcing the pier ordinance. Let Lake Geneva Club know if you are enforcing the 100’ pier head ordinance.

Plan Commission: Jean Black Barton Trust, Supervisor Weiss explained that this CSM did not go before the plan commission as it went to ETZ. It is almost a ten (10) acre parcel on S. lakeshore Drive and is in keeping with what the neighbors have done. Weiss/Holden motion to approve as presented. Carried without negative vote.

Geneva Lake Environmental Agency: discussed gypsy moths, donations are down

Pier Permits:

Weiss/Holden motion to approve the pier permit for Michael J. Ryan Trust, N1878 Black Point Road. Carried without negative vote.

Holden/Allis motion to approve the pier permit for Kenneth Knapcik, N2301 Knollwood. Carried without negative vote.

Allis/Weiss motion to approve the pier permit for Lake Geneva Country Club, W3396 S. Lakeshore Drive. Carried without negative vote.

Palmer/Holden motion to approve the pier permit for Boca Mac, LLC, W3415 Snake Road. Carried without negative vote.

Michael Lazzaroni, N2033 S. lakeshore Drive is requesting an additional driveway at his new home. Hwy. Superintendent Jim Wolfgram spoke against the driveway. They want 16’ and the Town requires 20’ and Lazzaroni already has two driveways. Police Chief Wisniewski spoke about the traffic study that was done and the landscape that makes it prohibitive. Allis/Palmer motion to deny request for an additional driveway. Carried without negative vote.

Weiss/Palmer motion to approve the 1 st reading of the ordinance regulating hours of construction work. Carried without negative vote.

7:40 pm

Holden/Palmer motion to convene into closed session per WI. Statute 19.85(1)(g) – conferring with legal counsel for the governmental body who is rendering oral or written advice concerning strategy to be adopted by the body with respect to litigation in which it is or is likely to become involved – Lake Geneva Club pier permit. Roll call vote: Bollweg, Weiss, Palmer, Allis, Holden all voted in the affirmative.

Palmer/Holden motion to reconvene into open session. Carried without negative vote.

Palmer/Weiss motion to appeal the Circuit Court decision in the Lake Geneva Club pier permit case. Roll call vote all present voting in the affirmative.

Weiss/Allis motion to adjourn. Meeting adjourned at 8:00 pm.
